A bench led by the Chief Justice set aside the High Court&#8217;s order dated May 4, 2024, which had called for a referendum on the relocation of the High Court. The Supreme Court clarified that ordering such a referendum does not lie within the High Court&#8217;s jurisdiction. During the hearing, the bench\u2014comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohana\u2014expressed strong disagreement with the High Court&#8217;s stance. In stern language, they stated that the High Court should have no involvement in passing orders of this nature; conducting a referendum is not the court&#8217;s function.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">It is noteworthy that the process of shifting the High Court from Nainital to Gaulapar, Haldwani, was already underway and has now received the Supreme Court&#8217;s approval. While setting aside the High Court&#8217;s controversial decision, the Supreme Court observed that there is an established administrative procedure for resolving issues related to infrastructure and relocation. The original order had been issued by a High Court bench comprising the then Chief Justice Ritu Bahri and Justice Rakesh Thapliyal. The High Court had previously deemed the land identified at Gaulapar in Haldwani unsuitable for the High Court.<\/p>\n<p style=\"text-align: justify;\">Finding a practical solution to this complex matter, the Supreme Court has directed that the entire dispute now be resolved at the administrative level. The Court stated that the Uttarakhand High Court should coordinate and consult with the state government regarding administrative aspects. The High Court and the state government should meet and devise a concrete solution for all infrastructural issues and problems related to the court complex.<\/p>\n<p style=\"text-align: justify;\">During the hearing, the Supreme Court was informed that the Uttarakhand government had already earmarked suitable land in Haldwani for the construction of the new High Court building. Taking this information on record, the Supreme Court ordered that the matter be expedited. The Court directed the state government to secure all necessary approvals and clearances for the identified land in Haldwani within the next six weeks. This matter reached the Supreme Court after the High Court Bar Association directly approached the country&#8217;s apex court to challenge the Nainital High Court&#8217;s decision to hold a referendum. While hearing the Bar Association&#8217;s appeal, the Supreme Court had initially stayed the High Court&#8217;s order and has now set it aside completely. The Court ordered that once all approvals are obtained, the land in Haldwani be immediately handed over to the High Court administration so that construction work on the new complex can proceed. What is a referendum? A referendum is a direct democratic process in which the entire public or electorate of a country or region votes directly on a specific proposal, law, or policy issue, rather than through representatives.
