Delhi: SC orders not to arrest actress Poonam Pandey in porn video case


New Delhi . The Supreme Court on Tuesday granted relief from arrest to Bollywood actress Poonam Pandey in a porn film racket case. Raj Kundra, husband of actress Shilpa Shetty is the main accused in this case.
A bench of Justice Vineet Saran and Justice BV Nagarathna also issued notice to the Maharashtra government on an appeal challenging the Bombay High Court order dismissing anticipatory bail plea. In its order, the top court said, issue notice, in the meantime, no coercive action will be taken against the petitioner.
The Bombay High Court had in November last year refused to grant relief to Poonam Pandey. After this, she had moved the Supreme Court challenging this order. Poonam Pandey has been made an accused along with actress Sherlyn Chopra in the FIR of Mumbai Police. On December 15, the Supreme Court had granted four weeks relief to Raj Kundra from arrest in a case related to a porn film racket.
The Bombay High Court in November had refused to entertain an anticipatory bail plea by Raj Kundra in connection with an FIR lodged against him by the Mumbai Police in the porn film racket case. Kundra approached the apex court after the High Court was denied relief. Kundra had earlier sought anticipatory bail from the sessions court which did not grant him any relief and thereafter Raj Kundra moved the Bombay High Court, claiming that he was allegedly implicated. The Cyber Cell of Mumbai Police had registered a case against Raj Kundra for allegedly distributing obscene videos under sections of the Indian Penal Code, Indecent Representation of Women (Prevention) Act, and Information Technology Act.
Raj Kundra claimed that he was not associated with the making, publishing or broadcasting of the alleged illegal videos. He was arrested by Mumbai Police in July last year in another case where Raj was accused of distributing porn movies through an app. Kundra was granted bail in September
